HYPOTHETICAL: After a third sexual assault in one school year connected to a Nerd Tech Greek party, the university placed the entire system on social probation. This prevented all fraternities and sororities from holding any social events – with or without alcohol – until the Greek leaders could come up with a plan to change the system’s culture. Connected with all the reported assaults were reports of “extreme intoxication” of underage students at social events hosted by Greek organizations. Nerd Tech President wrote a letter co-signed by the Vice President of Student Affairs and the Dean of Students, stating that a thoughtful plan for the cultural change needed to be proposed by the students within 30 days, at which time the topic of the social probation would be revisited. A huge cry has arisen from the Greek chapters’ members, alums, and national organizations threatening legal action if the social probation is not immediately lifted unless direct evidence of a specific Greek house can be shown. You are the director of Greek life and have been charged by the Vice President of Student Affairs to advise him as to whether the threat of legal action can be sustained. What do you say and why?
