Essay 3:

Fact Scenario: Sam is traveling from Jamaica to New York. His departure and destination country are both signatories (parties) to the Montreal Convention. Jamaica has three security checkpoints and only ticketed passengers can go through each security checkpoint. Sam passed through the first security checkpoint and on his way to the second he slipped and fell on a banana peel that was on the floor of the second security line. He sues the airline claiming the Montreal Convention applies. Will he succeed? Why or why not?
