Explaining 4th Amendment Rights

A key responsibility of school administration is to ensure that school settings are safe. Laws have been written to give administrators the ability to conduct searches of students based on reasonable suspicion that the students are carrying something illegal or potentially disruptive to the educational process. Administrators should be familiar with the laws that are relevant to student discipline and to search and seizure. One of the landmark Supreme Court cases mentioned in your text is New Jersey v. T.L.O. which was decided in 1985. It was key legislation in the area of search and seizure, whether or not a search warrant is needed to conduct a search on school property, and the parameters on what constitutes ‘reasonable grounds’ for a search. In a more recent piece of legislation from 2009, Safford Unified School District #1 et. Al. v. Redding, the Court ruled that school officials violated the Fourth Amendment when they searched a 13 year old girl. Read the full story of what happened, the rationale of the United States Supreme Court judges whose decision was upheld, and the dissenting opinion of the two judges who did not agree with the majority vote.

Based on what you have learned from the text and the website in the assignment introduction, prepare a PowerPoint presentation that you could use in a teacher in-service to inform teachers on the 4th amendment and student searches. Use the PowerPoint to inform district administration of your plan to conduct searches in your school and the role that you expect teachers to play in the searches. Include the following components: 

 Explanation of the case of New Jersey v. T.L.O. 

Explanation of how New Jersey v. T.L.O. was applied in the 2009 Supreme Court decision you read for the assignment introduction 

Include a list of what your school personnel must do and must avoid when conducting a student search. Also, use the notes section of the PowerPoint to make sure all relevant points are covered in the presentation. 

Length: 12-15 slides 

Notes Length: 100-150 words per slide 

Minimum of 5 scholarly resources required 

 Be sure to include citations for quotations and paraphrases with references in APA format and style where appropriate. Incorporate appropriate animations, transitions, and graphics as well as “speaker notes” for each slide. The speaker notes may be comprised of brief paragraphs or bulleted lists. Save the file as PPT with the correct course code information. 

 Your presentation should demonstrate thoughtful consideration of the ideas and concepts that are presented in the course and provide new thoughts and insights relating directly to this topic. Your paper should reflect scholarly writing and current APA standards.
