First, read Race and Crime ch. 10: Race to Execution before answering the following questions:

  1. Is there a racial element to how the death penalty is applied? Explain.
  2. Explain the terms “aggravating factors” and “mitigating factors”. Is there a racial component to how these concepts are applied?
  3. Why does the jury in a capital murder case have to be “death-qualified”? Should this be the case?
  4. Outline the most important court cases in understanding the limits of legal protection against racial discrimination in death penalty cases.
